Mr. Kipnis joined the firm in 1992. Mr. Kipnis heads the Firm’s Corporate Restructuring and Bankruptcy Group. He also devotes a substantial amount his time to leasing, developing and opening retail stores, representing national and regional chains. His varied practice includes complex bankruptcy matters, real estate, leasing issues and disputes, construction disputes, land use and zoning issues, contractual and licensing disputes, insurance coverage, patent and trademark litigation, foreclosure of major commercial loans, employment disputes, brokerage claims, securities fraud, insurance litigation and banking disputes under the Uniform Commercial Code. He practices in New York, New Jersey and Pennsylvania State courts and in various U.S. Bankruptcy and U.S. District Courts.
In addition to other successful Chapter 11 reorganizations, in 2009 as lead counsel, Mr. Kipnis successfully led the firm’s efforts to assist a famous theme restaurant’s emergence from Chapter 11 bankruptcy. As part of his representation Mr. Kipnis kept the case from being dismissed based on repeat filings in the notable reported decision, In re 1633 Broadway Mars Restaurant Corp., 388 B.R. 490 (Bankr. S.D.N.Y. 2008). Several years ago, Mr. Kipnis was appointed Chapter 11 debtor-in possession special counsel for the McCrory retailers, a 100 year old variety retail chain (operating under the McCrory, JJ Newberry and T.G. & Y. Store trade names). As part of his responsibilities, Mr. Kipnis directed the McCrory’s bankruptcy, including its bankruptcy court and other litigation and disposed of over 100 leases and multiple parcels of owned real property.
While at Hofstra Law School, Mr. Kipnis was a member of the Hofstra Law Review and graduated with distinction.
Mr. Kipnis is a member of the Association of the Bar of the City of New York and is the firm's computer/technology expert. From 1992 through 2001, Mr. Kipnis had been President of a 25-unit homeowner's association located in Long Island, New York and is currently President of his condominium association in Hunter, NY.
Mr Kipnis has obtained the prestigious AV rating from Martindale-Hubbell. As a member of the firm’s executive committee, he is deeply involved in its management and is responsible for the firm’s IT and accounting departments. |
